Can NRIs buy residential property in India?
Yes. NRIs can purchase residential and commercial property in India without RBI approval. Agricultural land, plantation property, and farmhouses require special permission.
What is FEMA and why does it matter?
The Foreign Exchange Management Act governs how NRIs transact. Payments must come from NRE/NRO accounts or via inward remittance, not from foreign currency held as cash.
Do I need to be in India to buy?
No. You can grant a Power of Attorney (POA) to a trusted person in India who can sign on your behalf. We help you draft a legally sound, notarised POA before you fly.
How is TDS handled on property purchase?
When an NRI buys from a resident seller, TDS is 1% of the transaction value. When buying from another NRI, TDS is 20% on long-term gains. Our tax partner clarifies your exact obligation before you book.
Can I repatriate the sale proceeds later?
Yes, up to USD 1 million per financial year from NRO accounts after paying applicable taxes. NRE account funds are freely repatriable.

NRIs can avail home loans from most major Indian banks and NBFCs. Repayments must come from NRE/NRO accounts. Loan-to-value is typically up to 80% of the property value.
